If you follow Chris Brown, you may be asking whether he will go to prison over the 2023 London nightclub attack. For now, he will not go to prison. A London court gave him a suspended eight-month sentence on Monday, October 26. Whether that sentence takes effect depends on what happens over the next 12 months.
US singer Chris Brown was sentenced at Southwark Crown Court in London for affray. Affray is a public order offence. It covers using or threatening unlawful violence in a way that would make a person of reasonable firmness fear for their safety. The offence relates to an attack at the Tape nightclub in Hanover Square, Mayfair, in February 2023. Police charged Brown in May 2025. Judge Tony Baumgartner imposed an eight-month sentence, suspended for 12 months. Brown's vocal coach, Omololu Akinlolu, received four months, also suspended for 12 months. Both men had pleaded guilty to affray in July 2026.
For anyone following Brown's career, the 12-month period is the key date. The court suspended the eight-month custodial term for 12 months. The term would take effect only if a court activates it during that period. Prosecutors dropped the more serious assault and attempted grievous bodily harm charges as part of the plea, and a weapons count was also dropped. For context on Brown's earlier court cases, read his legal history.
The victim was music producer Abraham Diaw. The prosecution alleged that Brown struck Diaw twice on the head with a glass bottle, and that Akinlolu punched him. Affray carries a maximum penalty of three years in prison. For how courts handle the offence, see how UK courts handle affray cases.
Did Chris Brown go to jail? Not immediately. The sentence is suspended. The eight months take effect only if a court activates the suspended sentence during the 12 months.
The judge gave his reasons in court. Baumgartner said the sentences were the briefest custodial terms that fit the offending. He said Brown's earlier violence convictions were relevant but now old. He cited Brown's guilty plea, bail compliance, charity work, a long music career and his four children as mitigating factors, IBTimes reported. He told Brown that his success and standing "do not entitle you to special treatment," according to IBTimes. The short-sentence rule in the Sentencing Act 2026 presumes suspension of prison terms of 12 months or less unless exceptional circumstances apply. Each man must pay £1,500 in costs, IBTimes reported.

His co-defendant received four months, also suspended. Prosecutors dropped the more serious assault and attempted grievous bodily harm charges.
